Terms of Service.
Last updated: 4 November 2026
These Terms govern access to the Diaposi website and application, including accounts, presentation conversion, interactive sessions, reports, personal learning journeys and AI-assisted tools (the “Service”). They form an agreement between the person or organisation using the Service (“you”) and the legal operator identified below (“Diaposi”).
1. Operator and legal notice
Operator
Diaposi is published by Diaposi, a société par actions simplifiée à associé unique (SASU) under French law with a share capital of 50 euros, whose registered office is at 9 Rue du Renard, 76000 Rouen, France, represented by its president, Alae Belaich. Its registration with the Trade and Companies Register of Rouen is in progress: until it is recorded, the president acts on behalf of the company in formation, and the company takes those acts over once registered.
The registration number, the VAT number, the telephone number and the host's details are kept up to date on the Legal notice.
Host
The Service is hosted by Contabo GmbH, Welfenstraße 22, 81541 Munich, Germany, registered at the Local Court of Munich under HRB 180722, VAT identification number DE267602842. The database is operated by MongoDB (Atlas) on Amazon Web Services in Paris, France; encrypted backups are kept with Backblaze in Amsterdam, Netherlands; email is delivered by HostGator.com LLC / Newfold Digital from Frankfurt, Germany.
Legal contact: legal@diaposi.com. Support: contact@diaposi.com. Do not send passwords, session credentials or recovery codes by email.
2. Acceptance and contractual documents
You accept these Terms when you create an account, expressly accept them in the interface, or use a feature clearly presented as subject to them. If you act for an organisation, you confirm that you have authority to bind it. If you do not accept the Terms, do not create an account or host a session.
The Legal notice identifies the publisher and the host; the Privacy Policy explains personal-data processing; the Cookie Policy explains device storage; the Security and data protection page describes public controls; and supplemental Beta Terms apply to an invited beta. A signed customer agreement or data-processing agreement prevails for its stated subject if it expressly conflicts with these public Terms. Mandatory law always prevails.
3. Eligibility and users
You may use an independent account only if you can legally enter the agreement or have the valid authorisation of a parent, guardian or organisation that can do so. A person using Diaposi through a school, university, employer or training organisation must follow that organisation's authorised instructions. Live participants may join without an account and are bound by the rules that concern participation and content.
The Service is designed as a teaching and learning aid. It is not an emergency service, a regulated examination-proctoring service, a student-information system, medical advice or a substitute for professional educational judgment.
You may open an account on your own if you are 15 or over. Beta participation requires you to be 18 or over. If you are under 15, you use Diaposi through your school, university or training organisation, which sets up the access and remains responsible for any parental authorisation its law requires. Joining a live session needs no account and no age check, because it asks nothing about who you are.
4. The current service and price
As of 4 November 2026, Diaposi is free of charge and sells nothing. There is no price, subscription, renewal or payment method, so the pre-contract information, withdrawal and sales-terms duties that attach to a consumer sale do not apply yet. Diaposi may introduce paid plans only after presenting, before the order, the price including taxes, the features included, the duration, the renewal and cancellation rules and the other information the law requires, with an online cancellation function where the law requires one.
The free plan has limits. An account receives monthly allowances, shown as credits, that cover live sessions and AI-assisted work, and a fixed number of learning spaces, practice exams and practice quizzes, with caps on files, videos and elements. The allowances and limits in force are shown in the account's Plan & billing page. An allowance that is not used is not carried over, and a slot that has been used is not given back when the item is deleted. Features marked Upgrade are not available in the free plan: pressing Upgrade only records your interest on a waiting list so that Diaposi can tell you when an offer exists. It creates no contract, no payment and no promise of a date.
Where a statutory distance-contract withdrawal right applies, a consumer may exercise it within the legal period by an unambiguous statement to the legal contact. The free Service does not ask a consumer to waive that right. A later paid digital supply must collect every prior request and acknowledgement required by law before claiming that a withdrawal right has ended.
5. Accounts and access credentials
- Provide accurate current information and keep it updated.
- Use an account only for yourself or the organisation that authorised you.
- Protect passwords, one-time codes, session links, report links and recovery codes; do not publish or share them beyond intended recipients.
- Notify Diaposi promptly of suspected unauthorised access and revoke access where the feature permits it.
- Do not bypass role, session, report or file-access controls.
You are responsible for activity performed with credentials under your control until you notify Diaposi, except to the extent the activity results from Diaposi's breach of its own obligations or mandatory law provides otherwise.
6. Institutional use
An institution determines the educational purpose, authorised users and lawful basis for the learner data it asks Diaposi to process. It must provide its own required notices, configure access appropriately, minimise the data collected, respond to learners and guardians, and obtain any internal approvals or parental involvement required by law. Diaposi's Terms acceptance is not consent on the institution's behalf.
Where Diaposi acts as a processor, institutional production use is subject to an Article 28 GDPR data-processing agreement. An institution must not deploy the Service for sensitive, high-risk or legally regulated processing beyond the documented features without prior written agreement and its own impact assessment.
7. Sessions, participation and reports
A host controls the session activities and decides what is displayed to the room. A participant must use the session code only for the intended session, submit only lawful and relevant content, and respect other participants. Contributions may appear live and later in a report under a random identifier; context may still reveal the author.
The host must tell participants what they can see, avoid requesting unnecessary identifying or sensitive information, moderate the room appropriately and protect report access. Report invitees must not forward access or export data for an incompatible purpose. Exported copies leave Diaposi's access controls and become the recipient's responsibility.
Some rooms ask each participant for a name, shown to the host and to the other participants: give your own name, or the name your host told you to use, and never somebody else's. A host may remove a participant and may require that new arrivals be let in before they join. When a room is used for a mock exam, the participant's answers are marked and shown to the host under that name, and the host alone decides what is done with them.
8. Acceptable use
You must comply with applicable law and may not use the Service to:
- upload or communicate unlawful, infringing, defamatory, threatening, harassing, discriminatory, sexually exploitative or deliberately harmful content;
- expose another person's personal or confidential data without authority, or solicit unnecessary special-category data;
- impersonate another person, misrepresent authority, cheat, manipulate an assessment or falsify educational evidence;
- distribute malware, probe or bypass security, access another user's material, overload the Service or disrupt a live session;
- scrape, harvest, resell or build profiles from participant or account data;
- reverse engineer the Service except where a non-waivable law expressly permits it;
- use AI output to deceive, or use the Service for prohibited biometric categorisation, emotion recognition in education, social scoring or unlawful automated decisions;
- remove notices, evade limits or use the Service to develop a competing model or service from protected outputs where prohibited by law or contract.
Good-faith security research is permitted only within the boundaries of the Security page and applicable law. It does not authorise access to another person's data or disruption of the Service.
9. Your content
You keep ownership of presentations, documents, questions, answers, comments, drawings and other material you submit (“User Content”). You grant Diaposi a non-exclusive, worldwide, royalty-free licence to host, copy, convert, transmit, display and otherwise process User Content only as needed to provide, secure, support and legally operate the Service. The licence ends when the content is deleted, subject to restricted backups, legal holds and copies lawfully made by other authorised users.
You confirm that you have the rights and permissions needed for User Content and for the audience with whom you share it. Do not upload third-party course material, student records, images, audio or confidential documents unless you are authorised to do so. Diaposi does not acquire ownership merely because it converts or stores a file.
10. Diaposi intellectual property
The Service, its software, interface, documentation, brands and original content are owned by Diaposi or its licensors and protected by applicable intellectual-property law. Subject to these Terms, Diaposi grants you a limited, personal or internal, non-exclusive, non-transferable, revocable right to use the Service for its intended educational and presentation purposes.
If you voluntarily provide feedback, you permit Diaposi to use it without restriction or payment, provided that Diaposi does not identify you publicly or disclose confidential information through that use without permission.
11. AI-assisted features
Some features generate or evaluate content using an external or self-hosted language model. AI output is probabilistic and can be inaccurate, incomplete, inappropriate or biased. You must check it against the source material and exercise professional judgment. It is not a guaranteed answer key, grade, legal opinion or factual authority.
Diaposi does not authorise use of AI output as the sole basis for admission, grading, discipline, employment, access to education or any other legal or similarly significant decision. A qualified person must review the context, allow correction and handle challenges. Diaposi presents such material as AI-assisted, so that users know when they receive material generated by AI, as Article 50 of Regulation (EU) 2024/1689 requires.
As between you and Diaposi, and to the extent permitted by law and third-party rights, you may use output generated for you. Similar or identical output may be generated for others. You remain responsible for checking whether your input and intended output use infringe another person's rights.
12. Privacy and security
The Privacy Policy describes controller roles, data categories, legal bases, recipients, transfers, retention and rights. The Cookie Notice lists browser storage. The Security page describes public controls. You must use the Service in a way that is consistent with those documents and with your own data-protection obligations.
13. Illegal content and moderation
Diaposi may investigate reported User Content and restrict, remove or preserve it where reasonably necessary to enforce these Terms, protect people or systems, comply with a valid order or address content believed to be illegal. Measures should be targeted, proportionate and respectful of applicable fundamental rights. Diaposi is not required to monitor all content generally.
A notice of allegedly illegal content should identify the exact location or session, explain the legal reason in enough detail for assessment, provide the notifier's name and email except where law permits omission, and include a good-faith statement that the information is accurate and complete. Where the Digital Services Act applies, Diaposi will acknowledge qualifying notices, decide them diligently and objectively, provide the affected person with required reasons, and identify available redress.
Contact point for authorities and for users, under Articles 11 and 12 of Regulation (EU) 2022/2065 (Digital Services Act): legal@diaposi.com, in French or English. Notices about unlawful content under Article 16 may be sent to the same address; give the address of the content, the reason it is said to be unlawful and a way to reach you. You receive an acknowledgement, a decision with its reasons, and the ways to contest it.
14. Availability, changes and beta features
Diaposi aims to provide the Service with reasonable care but does not promise uninterrupted or error-free availability. Maintenance, security events, provider failures, capacity limits or legal requirements may interrupt features. Users should keep appropriate copies of material they cannot recreate and should not rely on Diaposi as the only repository for teaching records.
Diaposi may improve, replace or discontinue features. For an account-based ongoing service, material adverse changes will receive proportionate advance notice where reasonably possible, unless an urgent security, legal or abuse risk requires faster action. Preview and beta features may change more frequently and are also governed by any supplemental beta terms.
15. Suspension and termination
You may stop using the Service at any time and may request account deletion through the available control or support channel. Diaposi may restrict a feature, suspend an account or terminate access where reasonably necessary for a material or repeated breach, security risk, unlawful conduct, non-payment under a future paid plan, or legal requirement.
Except where immediate action is necessary, Diaposi will give the affected account holder the reason and a reasonable opportunity to remedy or contest the measure. Where applicable law requires a statement of reasons or specific redress, Diaposi will provide it. Termination does not erase accrued rights, payment duties or provisions that by nature survive, including intellectual property, confidentiality, liability and dispute rules.
16. Data return and deletion
Available exports may be downloaded before account or content deletion. Diaposi does not promise that every internal technical field is exportable. Deletion and retention follow the Privacy Policy and any signed customer agreement. Data can remain temporarily in restricted backups or legal holds and is not available for ordinary use there.
17. Third-party services
Optional sign-in, email, infrastructure and AI features depend on third-party services. Their availability and independent processing may be governed by their own terms. Diaposi remains responsible for selecting and contracting processors as required, but is not responsible for a third-party service you use independently or a link outside Diaposi's control.
18. Legal guarantees and disclaimers
Nothing in these Terms excludes a mandatory statutory guarantee. Consumers may benefit from the French legal guarantee of conformity for digital content and services under Articles L.224-25-12 and following of the Consumer Code, where its conditions apply. Diaposi will provide mandatory remedies and updates required by law.
Outside mandatory guarantees, Diaposi provides preview and free features as available and does not guarantee that AI output, analytics, conversion or educational content is accurate or suitable for a particular curriculum or decision. This does not limit the duty to provide the agreed Service with reasonable care or any right that cannot legally be waived.
19. Liability
Each party is responsible for direct loss caused by its breach under applicable law. Diaposi is not liable for loss caused solely by unauthorised content, an insecure export, disclosure of a user-controlled credential, use contrary to these Terms, or a decision made without required human review, to the extent Diaposi did not cause or contribute to that loss.
No limitation applies where prohibited, including for fraud, wilful misconduct, death or personal injury caused by negligence, breach of a non-waivable data-protection duty, or mandatory consumer liability. Any negotiated business liability cap belongs in the signed customer agreement rather than being invented on this page.
20. Changes to these Terms
The date at the top identifies the current version. Diaposi may update the Terms for legal, security, technical or service reasons. Material changes affecting an ongoing account-based service will be notified in a durable or prominent form with reasonable advance notice where possible. If consent to new terms is legally required, continued passive use alone will not replace that consent.
21. Governing law and disputes
These Terms are governed by French law, without depriving a consumer habitually resident in another country of mandatory protections that apply there. The parties should first contact support and attempt a good-faith resolution. A consumer retains access to the competent courts and, after a prior written complaint, to the consumer mediator named in the Legal notice, where French mediation law applies. Between professionals, the Commercial Court of Rouen has jurisdiction.
22. General provisions
If a provision is invalid, the remaining provisions continue to apply and the invalid provision is interpreted or replaced only to the minimum extent permitted. A failure to enforce a provision once is not a waiver. You may not transfer the agreement without consent, except where mandatory law permits. Diaposi may transfer it as part of a genuine reorganisation or sale if user rights and data-protection duties remain protected and required notice is given.
The French and English versions are intended to convey the same rules. For users contracting in France, the French version governs to the extent permitted by mandatory law if a translation differs. This clause does not remove any language right or consumer protection that applies in another country.
